Divorce

A divorce is the process of dissolving (ending) your marriage. In order to obtain a divorce in England and Wales, the marriage has to have irretrievably broken down i.e. there is no hope of reconciliation, and you must have been married for 1 year.

Under the new ‘No Fault Divorce’, which was introduced in April 2022, there is no longer a requirement for couples to rely on one of the five facts to prove the ground for divorce. This removes any aspect of blame from the breakdown of a marriage and encourages a more straightforward approach to divorce.

The person who starts the divorce is known as the Applicant and their spouse is the Respondent. The process can take up to 6-9 months, following the 20-week wait which was introduced as a period of reflection.

Our clients are informed during the initial meeting of the divorce process, and it is explained in a way which is clear and concise. We aim to make the process as straight-forward as possible, while ensuring that our clients are properly advised. As part of our commitment to making the process easier, we offer face to face or Zoom appointments outside office hours and at weekends as we can understand that not everyone can take time out of a working day to see us. A specialist solicitor will be there to offer any advice and support through the process.

Divorce as the Petitioner

Is this right for you?

This option is for you if your spouse will co operate with the divorce. In other words they accept that the marriage has broken down. If this describes your situation this option is right for you. If your spouse is likely to object to the divorce this does not necessarily mean you are unable to start divorce proceedings but you should contact us for some initial advice to explain the options available to you.

What is included?

We will explain the divorce process in plain English. We will complete all the Court paperwork such as the Divorce Application and the Applications for Conditional and Final Orders.

We will write to the Court on your behalf and send them all the required documentation. We will keep you informed throughout.

What is not included?

This option does not cover any work in relation to financial matter or issues concerning your children such as contact. We can help you with this but that work will be charged for separately. Any additional costs will be explained to you before any further work is done for you.

How long does it take?

A divorce takes approximately 6 months from start to finish. We will prepare your documents promptly upon receipt of details from you. We know it is important to you that you want the divorce process to be dealt with as quickly as possible and we can assure you that we will deal with all ongoing work as promptly as possible.

Additional fees

On occasion the respondent receiving the divorce papers does not respond to the Court and we therefore have to take extra steps to prove to the Court that your spouse has received the divorce papers and these extra steps are not included in the fixed fee. If you cannot find your marriage certificate we can obtain a copy for you, for an additional charge. In the rare event that the Court requires you to attend Court there would be additional charges should you wish us to represent you in Court.

Any additional fees will be discussed and agreed with you beforehand.
